Trademark license provisions

Registration- and renewal rights

• In an exclusive-license agreement for a trademark, the licensee should consider negotiating the right to renew the mark’s registration if the mark owner doesn’t timely do so — otherwise, the registration might expire, possibly leaving the licensee with bupkis or close to it. This apparently happened to a licensee in Jurado Hermanos SL v OHIM, summarized in this Shepherd and Wedderburn memo.
