• Drafting an Arbitration Clause, by Gary H. Barnes (1997): A checklist of issues and sample clause language to consider, such as multiple arbitrators only when the amount in controversy exceeds X; language for allowing some discovery according to a schedule; and others.

• Background Checks: How Much Is Too Much? by Diane Krebs, New York Law Journal, March 30, 2009: Focuses mostly on New York law, but that may help with issue-spotting.
